Terms of Service and Plan License Agreement

These Terms of Service and Plan License Agreement (“Terms”) apply to all purchases, downloads, access, and use of plans, drawings, designs, renderings, digital files, documents, and related materials sold or provided by CenterPoint Drafting, LLC (“CenterPoint Drafting,” “we,” “us,” or “our”) through our online store, website, Shopify storefront, or related sales channels.

By purchasing, downloading, accessing, opening, printing, modifying, or using any plan or digital product from CenterPoint Drafting, you agree to be bound by these Terms. If you do not agree, do not purchase, download, access, or use our plans.

1. Products Sold

CenterPoint Drafting sells residential design plans, concept plans, stock plans, garage plans, building-related drawings, renderings, and/or other digital design materials. Product descriptions will identify, to the extent applicable, what is included with each purchase.

Unless expressly stated in the product description, our plans do not include site-specific engineering, structural calculations, truss design, foundation engineering, energy calculations, HVAC design, plumbing design, electrical design, soil reports, surveying, septic design, civil engineering, architectural stamping, engineering stamping, permit submission, construction administration, or local code review.

2. Digital Product Delivery

Most products are delivered digitally by download link, email, customer account access, or another electronic delivery method. You are responsible for downloading, saving, and backing up your purchased files.

We are not responsible for your failure to download, save, open, print, or maintain access to your files due to customer-side issues, including but not limited to email filtering, incorrect email address, device failure, software incompatibility, deleted files, internet issues, or expired links. However, we may, at our discretion, assist with reasonable file access issues.

3. License Grant

When you purchase a plan from CenterPoint Drafting, you are purchasing a limited license to use the plan. You are not purchasing ownership of the design, drawings, files, copyrights, intellectual property, or underlying work.

Unless a product description or separate written agreement expressly states otherwise, your purchase grants you a limited, non-exclusive, non-transferable, revocable license to use the purchased plan for one project and one structure only.

This means you may use the purchased plan to build one home, garage, or structure for your own project. You may share the plan only with parties directly involved in that specific project, such as your builder, contractor, subcontractors, lender, local building department, engineer, designer, architect, or other professionals assisting with that project.

4. Restrictions on Use

You may not, without our prior written permission:

  1. Build more than one structure from the purchased plan.

  2. Reuse the plan for another project, lot, customer, development, or property.

  3. Sell, resell, license, sublicense, rent, lease, transfer, publish, upload, distribute, share, give away, or otherwise make the plan available to others.

  4. Post the full plan set, CAD files, construction drawings, or technical drawings online or on any public platform.

  5. Use the plan as part of a plan book, catalog, competing plan service, drafting service, design service, builder package, or resale product.

  6. Copy, trace, redraw, reverse-engineer, or create a substantially similar plan for resale, redistribution, or repeated use.

  7. Remove copyright notices, title blocks, watermarks, disclaimers, or other ownership markings.

  8. Claim ownership or authorship of the plan or design.

  9. Use the plan in any unlawful, misleading, or unauthorized manner.

Any unauthorized use may result in termination of your license and may subject you to legal claims, damages, fees, and enforcement costs.

5. Modifications to Plans

You may modify the purchased plan as reasonably necessary for your one licensed project, including changes required by your builder, local building department, engineer, designer, architect, or other project professional.

Any modifications, redraws, conversions, additions, or derivative work based on our plans do not transfer ownership of the original plan or design to you. CenterPoint Drafting retains all rights in the original design, drawings, files, and intellectual property.

Modified plans may not be resold, redistributed, reused, or used to build additional structures unless we provide written permission or you purchase an additional license.

6. Local Codes, Permits, Engineering, and Site Conditions

Our plans are not guaranteed to comply with the building codes, zoning ordinances, subdivision rules, HOA requirements, energy codes, snow loads, wind loads, seismic requirements, frost-depth requirements, soil conditions, drainage requirements, foundation requirements, or other regulations that apply to your specific property or jurisdiction.

Before construction, you are solely responsible for having the plans reviewed, modified, approved, and, if required, stamped by properly licensed professionals in your state, county, city, or local jurisdiction.

You are responsible for confirming all requirements with your local building department, zoning authority, HOA, lender, builder, engineer, architect, surveyor, and other applicable professionals before purchasing materials, applying for permits, or beginning construction.

7. Not Architectural or Engineering Services Unless Expressly Stated

Unless expressly stated in writing, CenterPoint Drafting is not providing architectural services, engineering services, structural engineering, code certification, permit approval, construction supervision, construction management, or professional-of-record services through the sale of online plans.

Our plans may require review, modification, or certification by a licensed architect, licensed engineer, or other qualified professional before they can be used for permitting or construction in your area.

8. Customer Responsibility

You are responsible for determining whether a plan is suitable for your intended use, property, budget, builder, construction method, local code requirements, and personal needs before purchasing.

You are responsible for verifying dimensions, materials, structural requirements, construction methods, site conditions, utility requirements, and all other project-specific details before construction.

You agree not to rely solely on our plans as a substitute for professional review, local code verification, engineering, surveying, or construction expertise.

9. Product Images, Renderings, and Marketing Materials

Images, renderings, floor plan previews, square footage summaries, descriptions, and marketing materials are provided for general reference only. They may not show every detail included in the plan set and may include optional features, furnishings, finishes, landscaping, materials, or design elements not included in the purchased files.

Square footage, dimensions, roof pitches, foundation types, room sizes, specifications, and other plan information are approximate unless specifically stated otherwise. You and your project professionals are responsible for verifying all dimensions and requirements before construction.

10. No Guarantee of Permit Approval or Construction Cost

CenterPoint Drafting does not guarantee that any plan will be approved for permit, satisfy local requirements, meet lender requirements, meet HOA requirements, meet builder requirements, or be suitable for construction on your specific lot.

Any cost estimates, square footage estimates, material assumptions, or construction-related information are general only and are not guaranteed. Actual construction costs vary by location, labor market, materials, site conditions, code requirements, builder pricing, and other factors outside our control.

11. Refunds and Cancellations

Because our products are digital files and can be accessed, downloaded, copied, or used immediately after purchase, all sales are final unless otherwise required by law or expressly stated in writing by CenterPoint Drafting.

We do not offer refunds, returns, or exchanges because you changed your mind, selected the wrong plan, no longer intend to build, found a different plan, cannot obtain permit approval, need local modifications, dislike a design feature, or did not read the product description before purchase.

If you receive the wrong file, a corrupted file, or a file that cannot reasonably be accessed due to an issue on our end, please contact us at sales@centerpointdrafting.com. Our remedy, at our discretion, will be to provide a corrected file, replacement download, technical assistance, or refund.

12. Errors, Omissions, and Corrections

While we make reasonable efforts to provide accurate plans and information, errors, omissions, discrepancies, or conflicts may exist. You and your builder, engineer, architect, designer, or other project professionals are responsible for reviewing and verifying the plans before construction.

If you believe a plan contains an error, contact us at sales@centerpointdrafting.com. Our sole obligation, if we determine an error exists in our original files, is to provide a reasonable correction, clarification, replacement file, or refund at our discretion.

You agree that CenterPoint Drafting is not responsible for construction costs, delays, rework, labor, materials, permit issues, engineering costs, professional fees, lost profits, financing costs, loss of use, or other damages arising from plan errors, omissions, modifications, interpretation, or use.

13. Intellectual Property

All plans, drawings, designs, renderings, images, files, text, graphics, logos, product descriptions, and other materials provided by CenterPoint Drafting are owned by CenterPoint Drafting or its licensors and are protected by copyright, trademark, and other intellectual property laws.

No rights are granted except the limited license expressly stated in these Terms. All rights not expressly granted are reserved by CenterPoint Drafting.

14. Copyright Infringement and Unauthorized Use

Unauthorized copying, distribution, resale, reuse, modification for resale, publication, or construction beyond the licensed use is strictly prohibited.

If we discover or reasonably believe that a plan has been misused, copied, resold, distributed, posted online, used for multiple builds, or otherwise used outside the scope of the license, we may terminate your license, refuse future sales, issue takedown notices, pursue legal remedies, and seek damages, attorney fees, and enforcement costs where permitted by law.

15. Third-Party Services

Our store may use Shopify, payment processors, digital download services, tax calculation services, email services, analytics services, and other third-party tools. Your use of those services may be subject to their own terms, privacy policies, and practices.

We are not responsible for third-party platform outages, payment processing errors, app failures, email delivery issues, or service interruptions outside our reasonable control.

16. Payment, Pricing, and Taxes

Prices are listed in U.S. dollars unless otherwise stated. We reserve the right to change prices, product offerings, descriptions, included files, discounts, and availability at any time without notice.

You are responsible for all applicable taxes, fees, and charges associated with your purchase, unless collected by us at checkout.

17. Account and Order Information

You agree to provide accurate, current, and complete information when placing an order. We are not responsible for delays, failed delivery, or access issues caused by inaccurate information provided by you.

We may refuse, cancel, or limit any order if we believe the order is fraudulent, unauthorized, abusive, unlawful, violates these Terms, or creates unreasonable risk for CenterPoint Drafting.

18. Disclaimer of Warranties

To the fullest extent permitted by law, all plans, files, products, services, and information are provided “as is” and “as available,” without warranties of any kind, whether express or implied.

CenterPoint Drafting disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, code compliance, permit approval, constructability, accuracy, completeness, non-infringement, and suitability for your specific project, property, jurisdiction, or intended use.

19. Limitation of Liability

To the fullest extent permitted by law, CenterPoint Drafting shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to construction delays, increased construction costs, lost profits, loss of use, permit denial, professional fees, labor costs, material costs, rework, financing costs, or damages arising from use or inability to use the plans.

To the fullest extent permitted by law, CenterPoint Drafting’s total liability for any claim related to a purchased product shall not exceed the amount you paid to CenterPoint Drafting for that specific product.

20. Indemnification

You agree to indemnify, defend, and hold harmless CenterPoint Drafting, its owners, employees, contractors, agents, affiliates, and licensors from and against any claims, damages, losses, liabilities, costs, expenses, attorney fees, or demands arising out of or related to:

  1. Your use or misuse of the plans.

  2. Your construction project.

  3. Modifications made to the plans.

  4. Your failure to obtain required professional review, engineering, permits, inspections, approvals, or code compliance.

  5. Your violation of these Terms.

  6. Your infringement or misuse of our intellectual property.

  7. Claims by builders, contractors, subcontractors, property owners, buyers, neighbors, HOAs, government agencies, or other third parties related to your project.

21. No Assignment or Transfer

You may not assign, transfer, sublicense, or share your rights under these Terms or your plan license without prior written permission from CenterPoint Drafting. Any attempted assignment or transfer without permission is void.

22. Termination

We may terminate or suspend your license, access, or ability to purchase from us if you violate these Terms, misuse our plans, infringe our intellectual property, submit fraudulent information, abuse our services, or engage in unlawful conduct.

Upon termination, you must stop using the plans and destroy any unauthorized copies.

23. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles.

Any dispute arising out of or related to these Terms, our products, our store, or your use of our plans shall be handled in the state or federal courts located in Minnesota, unless otherwise required by applicable law.

24. Changes to These Terms

We may update these Terms at any time. Changes will be effective when posted on our website or store. The Terms in effect at the time of purchase will generally apply to that purchase, unless a change is required by law or relates to ongoing misuse, access, intellectual property protection, or enforcement.
